Terms of Use for the Website and Application

These Terms govern the use of the romanmasza.com website and the RomanMasza Social KPI application connected with Facebook and Instagram services. The website and application are jointly referred to as the “Service”.

1. General provisions

The Service provides information about the services of RM Sp. z o.o., enables users to submit enquiries and messages, and supports technical functions for working with connected accounts and social-platform data within the permissions granted.

By using the Service, the user confirms that they have read these Terms and agree to comply with them. A user who does not agree with the Terms must stop using the Service.

RM Sp. z o.o. is the Data Controller for personal data processed in connection with the Service. Roman Protsenko coordinates data subject requests and deletion requests. This designation does not constitute the appointment of Roman Protsenko as a Data Protection Officer (DPO).

3. Purpose of the Service

  • publishing information about the Company’s services and projects;
  • submitting enquiries, requests and messages through forms or other communication channels;
  • assessing whether services can be provided and responding to users;
  • connecting Facebook and Instagram accounts belonging to the Company or its authorised users;
  • receiving and organising posts, comments, replies, statistics and technical identifiers available through authorised APIs;
  • organising replies, monitoring response times, and preparing internal reports, quality indicators and aggregated analytics;
  • preliminary automated classification of work events and prioritisation, without decisions producing legal or similarly significant effects for users;
  • security, diagnostics and technical support.

The exact functions depend on the services actually connected, permissions available and the current configuration of the application.

4. Informational nature of content

Unless expressly stated otherwise, information on the website is provided for general informational purposes. Descriptions of services, contact buttons, forms, publications and other materials do not by themselves create a contract or an unconditional obligation to provide a service.

5. Enquiries and messages

When submitting an enquiry, the user confirms that the information provided is current and accurate and may be used to respond. Submission of a form or message:

  • does not guarantee that a service will be provided;
  • does not automatically conclude a contract;
  • may require additional verification and contact with the user;
  • does not confirm technical or organisational feasibility until the assessment is complete.

6. Connecting Facebook and Instagram

By connecting a Facebook or Instagram account, the user confirms that they have the rights and authority required to manage that account and grant the permissions requested by the application.

The user may revoke the application’s access through the settings of the relevant platform. Revocation stops further collection within the revoked permissions but does not always automatically delete data already stored. The Data Deletion Instructions should be used to delete locally stored data.

Facebook and Instagram are third-party platforms. Their availability, interfaces, APIs, permissions and rules may change independently of RM Sp. z o.o.

7. Information for comment authors

Comments and replies posted under content on public business accounts of RM Sp. z o.o. may be obtained through authorised Meta interfaces and processed in RomanMasza Social KPI for reply management, response-time monitoring, statistics, quality review and preliminary AI classification.

Detailed information on categories of data, sources, purposes, legal bases, retention periods and rights is provided in the Privacy Policy. A link to that Policy must be available on the website, in related business profiles and in the application connection interface. Where reasonable and technically feasible, a short notice may also be provided at the first direct contact.

8. Acceptable use

The user must use the Service lawfully and in good faith. In particular, the user must not:

  • use the Service for unlawful purposes, fraud, spam or infringement of third-party rights;
  • submit false, misleading, harmful or unlawful data;
  • attempt to obtain unauthorised access to the Service, accounts, tokens, systems or data;
  • interfere with the website, application, API or technical infrastructure;
  • connect an account or use data without lawful authority;
  • copy or use Service materials in infringement of intellectual-property rights.

9. Personal data, retention and deletion

Personal data is processed in accordance with the Privacy Policy. The principal retention periods are:

  • enquiries and correspondence: no more than 14 months after the enquiry is closed or the last meaningful contact;
  • comments, replies, post identifiers and author identifiers: no more than 14 months from receipt of each individual record;
  • work cases and quality reviews: no more than 14 months after the case is closed;
  • technical and analytics logs: no more than 14 months from creation unless needed to investigate an incident or defend legal claims;
  • access tokens and connection data: until revocation, expiry, termination of the integration or earlier loss of necessity.

At the end of the applicable period, data is deleted or irreversibly anonymised. Backup copies are deleted or overwritten under the backup cycle, normally no later than 90 days after deletion from active systems.

Contractual, accounting, tax, employment, security-incident and legal-claims data may be retained longer only to the extent and for the period required by law or necessary for the establishment, exercise or defence of legal claims.

Roman Protsenko coordinates deletion requests. The procedure is described in the separate Data Deletion Instructions.

10. Cookies, analytics and technical tools

The website may use strictly necessary, functional and analytics cookies, Google Tag Manager and Google Analytics 4. Optional categories operate under prior consent: the relevant tags are blocked until the user makes a choice. Users must have equally accessible options to accept, reject or configure optional categories.

Google Analytics 4 user-level and event-level data retention is set to 14 months, and resetting that retention period upon new activity is disabled. The exact list of active cookies and technologies is displayed in the consent settings and must match the actual website configuration.

11. Third-party services

The Service may include links to third-party websites, platforms, messaging services and tools. Their use is governed by the terms and policies of their respective providers. RM Sp. z o.o. does not control the operation, availability or content of third-party services.

12. Intellectual property

Unless stated otherwise, texts, structure, design, graphics, logos, images, software elements and other Service materials belong to RM Sp. z o.o. or are used lawfully. Copying, distributing, modifying or commercially using them without permission is prohibited except where expressly permitted by law.

13. Availability and changes to the Service

RM Sp. z o.o. may change, suspend or discontinue Service functions because of maintenance, API changes, platform rules, security requirements or legislation. Continuous and error-free availability is not guaranteed.

14. Limitation of liability

To the extent permitted by law, RM Sp. z o.o. is not liable for consequences of unlawful user conduct, acts of third parties, internet or hosting outages, third-party platform failures, API changes, revocation of permissions or other external circumstances beyond its reasonable control. Liability that cannot lawfully be excluded remains unaffected.

15. Changes to these Terms

These Terms may be updated periodically. The current version is published on the website with the date of the latest update. Material changes may also be communicated by other available means.

16. Governing law and contact

These Terms are governed by the laws of the Republic of Poland and applicable European Union law.
