No. Najem okazjonalny does not permit a self-help eviction. The tenancy must first end lawfully; the owner then serves a written demand, obtains a court enforcement clause and proceeds through a court enforcement officer. Non-payment, serious misuse, unauthorised subletting or failure to replace a lost alternative address may be relevant.
The owner must notify the tax office within 14 days from the tenancy start date to rely on the special regime. Missing the deadline does not automatically invalidate every tenancy agreement, but it limits the application of the najem okazjonalny rules.
